Contracting party: Atlas Global Education Ltd, company 17250730, incorporated in England and Wales, registered office Albany House, 14 Shute End, Wokingham, England, RG40 1BJ. IELPS is its trading name and education platform.
1. Scope and acceptance
These Terms govern access to IELPS websites, applications, diagnostics, lessons, modules, subscriptions, school services, certificates and related content. The person purchasing or activating an account confirms that they can enter the contract or have authority to act for the learner, parent/guardian, school or organisation. The exact Terms, Privacy Notice and Refund Policy versions accepted at checkout must be recorded with timestamp and locale.
2. Accounts and children
Learners must be at least six. A learner below the locally applicable age of independent digital consent may use IELPS only after a verified parent/guardian or authorised school activates the child relationship. The payer, child and school authority are separate roles. Credentials must not be shared. Parent and school access is limited to the verified relationship and scope recorded by IELPS.
3. Diagnostic and learning results
The diagnostic and CEFR-aligned learning results are educational guidance. They are not IELTS, Cambridge English or another third-party examination, immigration result, regulated qualification or guarantee of admission or employment. Personalisation may use learning activity necessary to provide the service; advertising profiling and sale of child data are prohibited.
4. Offers, payment and taxes
Only the server-authoritative offer and market registries determine what may be bought. Browsing availability does not mean checkout is lawful in every country. The checkout must show the plan/module, total price, currency, tax treatment, renewal date if any, access duration and material restrictions before payment. No tax registration number and no separate tax charge may be displayed unless Finance supplies evidence and the approved registry changes.
PAYG consists of 48 five-lesson modules across A1-C2. Access to a paid module is permanent while its entitlement remains effective. The first purchasable module contains the server-recommended lesson; later purchases are restricted to the next verified-incomplete eligible module. A reservation expires after 31 minutes. The once-only USD 3 credit may be consumed against the first eligible PAYG module or first subscription invoice.
Subscriptions renew only as stated at checkout. Cancellation stops future renewal and normally preserves access to the end of the paid period. The market schedule controls reminders, cancellation rights, digital-content commencement, refunds and price-change notice. An annual subscriber cannot be silently moved to a new price.
5. Refunds, disputes and access
The published Refund Policy and mandatory local consumer law apply. A full completed PAYG refund or lost chargeback revokes access to that module; an open chargeback suspends it. Partial refunds and suspected fraud enter manual review. No payment dispute automatically causes a permanent account ban. The once-only USD 3 credit stays consumed after refund or chargeback unless an Administrator approves a correction for a documented duplicate charge, provider failure or administrative error. Corrections require the original event, reason code and idempotency key.
Where you buy as a consumer, you have a statutory 14-day cooling-off period. If you ask for immediate access to digital content within that period and acknowledge that you lose the right to cancel, the cooling-off right ends when access begins.
6. Content licence and restrictions
IELPS grants the authorised user a personal, limited, non-exclusive, non-transferable, revocable licence to use the service and its content for learning or the contracted school purpose. Ownership does not transfer. Except where mandatory law permits and cannot be excluded, users must not copy, republish, sell, sublicense, scrape, systematically download, remove rights notices, bypass access controls, extract assessment banks, use automated means to reproduce content, reverse engineer protected service components, create derivative commercial courseware, or use IELPS content or outputs to train or evaluate a competing model or service without written permission. Statutory rights to observe, study, test interoperability, quote, criticise, review, teach or make accessible copies remain unaffected where applicable.
User submissions remain the user’s content. The user grants IELPS only the rights reasonably needed to host, secure, assess, moderate and return that submission and to meet legal obligations. IELPS does not obtain a licence to sell child submissions or use them for advertising.
7. Acceptable use and safeguarding
Users must not harass, groom, exploit, impersonate, cheat, upload unlawful or harmful material, probe security, disrupt service, or contact a child outside approved platform routes. Safeguarding reports are handled through a restricted route. IELPS is not an emergency service; immediate danger must be reported to the local emergency services.
8. Tutoring, media and recording
Live tutoring is held and unavailable unless separately approved. Recording defaults off. No public media, educator claim, qualification claim, voice or introduction video may be served unless its evidence record is approved and current. Tutor identity verification alone is not a safeguarding clearance.
9. Certificates
Certificates require the published academic evidence and lawful course access, regardless of whether access came through PAYG, subscription or school. A certificate is an IELPS record of achievement and is not an accredited qualification unless a future notice identifies the accreditor and scope. Public verification must disclose only status, certificate ID, IELPS level, issue date, revocation status and the non-accreditation notice by default.
10. Availability, changes and termination
IELPS may maintain, secure or lawfully modify the service. Material contractual changes take effect only after durable notice and any required consent. Access may be suspended proportionately for security, safeguarding, unlawful use or payment state. Users receive an explanation and review route unless prohibited by law or safeguarding needs.
11. Liability and mandatory rights
Nothing excludes liability that cannot lawfully be excluded, including fraud, fraudulent misrepresentation or death/personal injury caused by negligence where applicable. Consumer remedies and mandatory local rights are preserved. Any liability limitation, school indemnity or business-loss exclusion requires final legal approval and must be stated in the published version; none is asserted by this draft.
12. Governing law and disputes
These Terms are governed by the law of England and Wales. Courts or dispute routes must follow the approved market registry and contract type. This clause does not remove mandatory protections or a mandatory forum available to a consumer in their country. Schools and enterprises use a separate signed order form covering data roles, safeguarding responsibilities, service levels and disputes.
